Trump Ends DACA Program
Today, the President and the Department of Homeland Security announced the termination of the Deferred Action for Childhood Arrivals program (DACA) in six months. We feared this day would come since we learned the results of the elections in November of 2016. For nine months, 800,000 young men and women have worked and gone to college knowing that their future could change any minute. In our own community, the lives of 30 young people and their families will feel the impact of this change.
DACA, enacted in 2012 by executive order, protected eligible youth from deportation and provided them with a work permit. While the program has ended, the fight must continue more than ever. These children, our children, our neighbors, our friends, are counting on us to stand up for them.
Our hearts are with the DACA youth in our community and the country. You are not alone, we are with you, and in the months to come we will do everything in our hands to press Congress to pass legislation that acknowledges your contributions and is fair for you.
Keep in mind that:
1) If your DACA expires on/before March 5, 2018, you have until October 5, 2017 to file a renewal and get two more years.
2) For those whose DACA expires later than March 5, 2018, they are no longer eligible to file for renewals.
3) No new initial applications will be processed if they not been filed already, as of today.
4) No new advance parole requests will be granted. Pending applications will be denied, and money refunded.
In the meantime here is some advice from our partners at SIREN of the Bay Area.
- You have the right to work legally until your work permit expires.
- You have no obligation to inform your employer that DACA has ended; your employer does not have the right to ask whether you are a DACA-recipient or how you got your work permit.
- Your employer does not have the right to fire you until after your work permit expires; if your expiration date is nearing, your employer may ask you for an updated work permit but cannot take any action against you until after it expires.
- Your Social Security Number is valid for life, even if your work permit or DACA expires.
- If you have a regular driver’s license and it expires after the program is terminated, you can still apply for an AB 60 driver’s license in California.
- If you are outside the US on advance parole, return as soon as possible.
- Seek trusted legal advice, especially if you are thinking of leaving the country, would like to be screened for other potential immigration benefits, or if you have encountered any criminal issues since receiving DACA.
- Remind yourself of your rights with ICE.

Hoy, el Presidente y el Departamento de Seguridad Nacional anunciaron la terminación del programa Acción Diferida para Llegados de Infancia (DACA) en seis meses. Temíamos que este día llegaría desde que aprendimos los resultados de las elecciones de noviembre de 2016. Durante nueve meses, 800, 000 hombres y mujeres jóvenes han trabajado y asistido a la universidad sabiendo que su futuro podría cambiar en cualquier momento. En nuestra propia comunidad, las vidas de 30 jóvenes y sus familias sentirán el impacto de este cambio.
DACA, promulgado en el 2012 por orden ejecutiva, protegió a los jóvenes elegibles de la deportación y les proporcionó un permiso de trabajo. Manten eso en mente:
1) Si su DACA expira el/antes del 5 de marzo de 2018, tiene hasta el 5 de octubre de 2017 para presentar una renovación y obtener dos años más.
2) Para aquellas personas cuya DACA se vence después del 5 de marzo de 2018, ya no son elegibles para solicitar la renovación.
3) No se procesarán nuevas solicitudes iniciales si no se han presentado ya, a partir de hoy.
4) No se otorgarán nuevas solicitudes de permiso de entrada. Se denegarán las solicitudes pendientes y se reembolsará el dinero.
Mientras tanto, aquí hay algunos consejos de nuestros socios de SIREN del Área de la Bahía.
- Si el programa termina y los beneficiarios de DACA pueden conservar sus permisos de trabajo, tendrán el derecho a trabajar legalmente hasta que expire su permiso de trabajo.
- Incluso si el programa termina, usted no tiene obligación de informar a su empleador que DACA ha terminado; su empleador no tiene el derecho de preguntar si usted es un receptor de DACA o cómo obtuvo su permiso de trabajo.
- Su empleador no tiene derecho a despedirlo hasta que expire su permiso de trabajo; si su fecha de vencimiento está cerca, su patrón puede pedirle un permiso de trabajo actualizado pero no puede tomar ninguna acción contra usted hasta después de que expire.
- Su número de seguro social es válido para toda la vida, incluso si su permiso de trabajo o DACA expira.
- Si usted tiene una licencia de conducir regular y expira después de que el programa se termine, usted todavía puede solicitar una licencia de conducir AB 60.
- Si usted está fuera de los Estados Unidos con permiso de entrada, regrese lo antes posible.
